Navigating The Perils
In the rapidly evolving landscape of legal technology, artificial intelligence (AI) promises to revolutionise how lawyers conduct research, draft documents, and analyse cases. Tools like large language models (LLMs) can sift through vast datasets in seconds, offering efficiencies that were once unimaginable. The allure of AI nevertheless comes with profound risks. As we explore in this first installment of our series on AI governance in law, unchecked adoption can expose firms to breaches of confidentiality, regulatory non-compliance, factual inaccuracies, ethical pitfalls, and emerging legislative hurdles. Understanding these dangers is the first step toward responsible innovation.
At the forefront is data confidentiality, a cornerstone of legal ethics. When confidential details are inputted into an LLM, control is irrevocably surrendered. Many free or public AI platforms explicitly state that user data may fuel future model training, creating a direct conflict with the duty of confidentiality. Real-world incidents underscore this vulnerability: in 2023, OpenAI’s ChatGPT suffered a breach exposing user chats, highlighting how even sophisticated systems falter. Lawyers remain accountable for such lapses, potentially facing disciplinary action or client lawsuits.
Compounding this is regulatory and jurisdictional vulnerability. Free AI tools optimize for cost by routing data to the most efficient servers worldwide, often outside the UK or EU. This “lack of data residency control” contravenes UK GDPR Article 44, which prohibits transfers of personal data to third countries without adequate safeguards. For a UK lawyer, demonstrating compliance to the SRA or clients becomes impossible if data resides on, say, a U.S. server lacking equivalent protections. The consequences? Fines up to 4% of global turnover, reputational damage, and eroded trust.
Then there are hallucinations—AI’s tendency to generate plausible but fabricated outputs. General LLMs might confidently cite nonexistent case law or erroneous legal summaries, misleading even seasoned practitioners. Relying on such unverified content violates SRA Code paragraph 3.1, which requires competence in service delivery. A single erroneous brief could unravel a case, inviting malpractice claims.
Ethical concerns extend to bias, ethics, and auditability. AI operates as a “black box,” rendering its decision-making opaque and impossible to fully audit. In legal contexts, biased outputs could skew advice on sensitive matters like employment or family law, fostering discrimination and ethical breaches. Without traceability, defending against challenges becomes untenable.
Looking ahead, the EU AI Act, set to phase in from 2026, amplifies these risks. High-risk systems—those impacting legal rights or access to justice—will demand rigorous risk assessments, human oversight, logging, and bias testing. Firms must classify tools accordingly and maintain internal registers, or face penalties.
AI’s potential in law is undeniable, but as this article illustrates, the risks are equally stark.
